What do I have to prove?

To succeed in a claim for compensation for personal injury you will have to prove that you have suffered injury, that somebody else was negligent and that this negligence caused your injury. It is not sufficient only to prove that you have been injured. You will need to give full details of the circumstances surrounding the accident in which you were involved.

What can I claim for?

Generally speaking you can claim for any loss or losses caused by the accident. If your claim is successful you will be compensated for your injury, pain, suffering and loss of enjoyment of life and also for any of your financial losses incurred directly as a result of the accident, such as, loss of earnings, cost of private medical treatment, replacement or repair of your car and so on.

It is very important to keep receipts for all out-of-pocket expenses associated with your accident and to make sure that they are recorded in detail. Your financial losses will be set out in a schedule and up-dated throughout your claim.

You are under a duty to mitigate your losses and therefore even if the accident is not your fault, you are legally obliged to keep your losses to a minimum. For example, after a road traffic accident you should only hire a vehicle if it would be genuinely difficult for you to manage without one.

How much will I get?

If you are injured, it is difficult and often impossible, to say in the early stages of a claim how much compensation you should receive. Every injury is different and it will depend on how serious your injuries are and for how long they last. You will need to be medically examined eventually and, when the medical evidence is available, you will receive an estimate of compensation for your injuries.

In relation to financial losses, provided somebody else is to blame for the accident, you will usually be able to recover all losses claimed. It is important to note that you must have documentation to support the losses claimed.

Even if you are partly to blame for the accident, you can still recover part of your compensation.

How long will it take?

If liability is admitted, and your injuries are not serious, your claim may settle within six to twelve months. If liability for the accident is not admitted and your injuries are serious, your claim will take longer to resolve.

Will I have to go to Court?

It is unlikely that you will need to go to Court. We may start legal proceedings to encourage the Insurance Company to process your claim and enable you to claim interest on your losses. Our vigorous expert handling of cases usually secures a settlement without a Court Hearing.

How much will it cost me?

Nothing! There are different ways to fund a personal injury claim. You may have legal expenses insurance to cover the costs. If not, we will advise you how to proceed with no cost to you. If you enter into a Conditional Fee Agreement (No Win, No Fee) and your claim is unsuccessful there will be no charge to you. We will not deduct anything from your compensation payment.
